Company Release - 9/4/2009 5:19 PM ET
PORT WASHINGTON, N.Y.--(BUSINESS WIRE)--
Systemax Inc. (NYSE: SYX) announced that a complaint was filed today by
the Florida Attorney General (AG) against the Company and certain of its
subsidiaries in the Circuit Court of the Eleventh Judicial Circuit, in
Miami-Dade County, Florida. The complaint relates to rebate processing
activities conducted by OnRebate Inc, primarily during 2005-early 2007.
A separate class action lawsuit making similar allegations was filed in
federal court in 2007. On August 31, 2009 the U.S District Court for the
Southern District of Florida issued a final order of dismissal of that
case.
A Company spokesperson stated, "We are pleased that we prevailed in
federal court in the Vukson matter. OnRebate processed and paid over 2
million individual rebates. While there were relatively few customer
complaints, and we regret any of them, we believe all customers who were
entitled to rebates did receive them. The Company denies the allegations
in the Florida AG complaint and will vigorously defend itself and its
subsidiaries."
